Terms of Service

We wrote these Terms in plain language so you can actually understand them. Please read them carefully — by using WhenIGo, you agree to be bound by them. If you have questions, email us at support@forwhenigo.com.
1. Who We Are and What We Do
WhenIGo.io and ForWhenIGo.com (together, “WhenIGo,” “we,” “our,” or “us”) operate as the same service — ForWhenIGo.com is our primary consumer-facing website, and WhenIGo.io redirects there. WhenIGo is a subsidiary of Blue Butterfly Inc., a Delaware corporation (921 H St NE #115, Washington, DC 20002).
WhenIGo is a digital funeral pre-planning platform. We provide tools to help you document your end-of-life wishes, store personal content and legal documents, designate trusted contacts, and connect with third-party service providers who can help carry out those wishes. We are not a funeral home, cemetery, insurance company, pre-need seller, attorney, or financial advisor. We do not hold or administer funeral trust funds or estate assets.
2. Acceptance of Terms
By creating an account, accessing, or using the WhenIGo platform (the “Service”), you agree to these Terms of Service (“Terms”) and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.
You must be at least 13 years old to use WhenIGo. By using the Service, you represent that you are 13 or older. If you are under 18, you represent that you have your parent or guardian’s permission to use the Service.
These Terms constitute a binding legal agreement between you and Blue Butterfly Inc. If you are using WhenIGo on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
The Service is intended for residents of the United States only. By using the Service, you represent that you are located in the United States. We make no representation that the Service is appropriate or available for use outside the U.S. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
3. Your Account
To use the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information when creating your account.
- Keep your account information up to date, including your email address and payment information.
- Keep your login credentials confidential and not share them with anyone.
- Notify us immediately at support@forwhenigo.com if you suspect unauthorized access to your account.
- Accept responsibility for all activity that occurs under your account.
You may sign in using Google or Yahoo via OAuth. By doing so, you authorize WhenIGo to receive your name and email address from that provider. You can revoke this access at any time through your Google or Yahoo account settings. See our Privacy Policy for details on how we handle sign-in data.
4. Subscription, Fees & Payment
WhenIGo offers tiered subscription plans. Current pricing is available at ForWhenIGo.com/pricing. All fees are stated in U.S. dollars.
- Subscription start. Your subscription begins when you complete the setup process and pay the applicable setup fee. An annual subscription fee is charged to keep your account active.
- Auto-renewal. Your annual subscription will automatically renew on each anniversary of your subscription start date. We will charge the renewal fee to your payment method on file.
- Payment failure. If we are unable to process your renewal payment, we will notify you at the email address on file and give you the opportunity to update your payment information. If payment is not received after reasonable notice, your account may be deactivated and your data deleted in accordance with our Privacy Policy.
- Refunds. All fees are non-refundable except as required by applicable law or as expressly stated in these Terms. If you cancel your subscription, you will retain access to the Service through the end of your current paid period.
- Price changes. We may change our pricing at any time. We will give you at least 30 days’ notice before any price change takes effect. Your continued use of the Service after the price change constitutes your acceptance of the new pricing.
- Taxes. You are responsible for all applicable taxes. We will collect taxes where required by law.
5. Your Content
You may upload, store, and share content through the Service, including preferences, notes, photos, music choices, legacy letters, legacy gifts, your personal story (“My Story”), trusted contact information, and legal documents such as wills, trusts, advance directives, and powers of attorney (collectively, “Your Content”).
- Ownership. You retain full ownership of Your Content. By uploading content to WhenIGo, you grant us a limited, non-exclusive, royalty-free license to store, display, and transmit Your Content solely as necessary to provide the Service to you and your designated trusted contacts.
- Responsibility. You are solely responsible for Your Content. You represent that you have all rights necessary to upload Your Content and that it does not violate any law or third-party rights.
- Legal documents. WhenIGo does not review, interpret, validate, or provide legal advice regarding any legal documents you upload. We store them solely as a convenience. You are responsible for ensuring that uploaded legal documents are accurate, current, and legally valid in your jurisdiction.
- Prohibited content. You may not upload content that is illegal, harmful, harassing, defamatory, or that infringes any third-party intellectual property rights.
- No advertising use. We do not use Your Content for advertising, profiling, or to train machine learning models. See our Privacy Policy for full details on how we handle your data.
- Data export. You may download or export Your Content at any time through your account settings. We will provide your content in a commonly used, machine-readable format. This right is in addition to any data portability rights you may have under applicable law.
6. Trusted Contacts
You may designate one or more trusted contacts within the Service who will be granted access to specified portions of your plan after your passing or upon a triggering event you define.
- Granular access. You control what each trusted contact can see. Trusted contacts will only be able to access the portions of your plan you explicitly authorize.
- Consent. By designating a trusted contact, you represent that you have that person’s consent to share their contact information with WhenIGo and to notify them in connection with your plan.
- Changes. You can add, change, or remove trusted contacts at any time while your account is active.
- Trusted contact verification. Trusted contacts are required to complete a verification process before accessing your plan. This includes answering security verification questions you establish during setup. Access is granted only upon successful verification.
- Post-death access. After your death, a verified immediate family member or legal representative may also request access to your plan. Executors and legal representatives must submit official documentation confirming their authority — such as Letters Testamentary, a court order, or equivalent legal instrument — before any access is granted. Family members who are not designated trusted contacts must provide proof of identity and their relationship to the account holder.
- Disputed access. If multiple parties present conflicting claims to access your plan — for example, a designated trusted contact and an executor with differing instructions — WhenIGo will suspend access to the disputed portions of the plan and require the parties to resolve the conflict through legal process before we grant access. WhenIGo is not a party to such disputes and will not make determinations about competing legal claims.
WhenIGo does not independently distribute, act upon, or enforce your plan or uploaded legal documents. We are a storage and communication platform only.
7. Third-Party Services & Partners
WhenIGo may connect you with third-party service providers, including funeral homes, insurance providers, financing companies, estate planning attorneys, will and trust companies, florists, and other vendors (collectively, “Third-Party Partners”).
- Independent agreements. Any contract, agreement, purchase, or engagement you enter into with a Third-Party Partner is solely between you and that partner. WhenIGo is not a party to those agreements and has no liability under them.
- No endorsement. Third-Party Partners are separately licensed and regulated under applicable state law. WhenIGo makes no representations about the quality, legality, or suitability of any Third-Party Partner’s services.
- Third-party privacy. When you are redirected to a Third-Party Partner’s website or service, that partner’s own privacy policy and terms of service govern your interaction with them. WhenIGo is not responsible for third-party privacy practices.
- Handoff notice. We will display a clear notice before redirecting you to any Third-Party Partner, identifying them and letting you know their terms — not ours — will apply.
- Data sharing consent. We will ask for your explicit consent before sharing any of your personal data with a Third-Party Partner on your behalf.
8. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights.
- Upload or transmit malware, viruses, or any harmful code.
- Attempt to gain unauthorized access to the Service, other user accounts, or our systems.
- Scrape, crawl, or harvest data from the Service without our written permission.
- Use the Service for any commercial purpose not expressly authorized by these Terms.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service on behalf of any person under 13 years of age.
We reserve the right to suspend or terminate your account if we reasonably believe you have violated these acceptable use standards, with or without prior notice depending on the severity of the violation.
9. Intellectual Property
The WhenIGo platform, including its software, design, text, graphics, logos, and all other content created by us (excluding Your Content), is owned by Blue Butterfly Inc. and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent.
If you provide us with feedback or suggestions about the Service (not including Your Content), you grant us a perpetual, irrevocable, royalty-free license to use that feedback to improve the Service. This feedback license does not apply to Your Content, which remains yours and is governed by Section 5.
10. Copyright & DMCA Policy
WhenIGo respects the intellectual property rights of others and expects users to do the same. If you believe that content stored on or accessible through the Service infringes your copyright, you may submit a written notice to our designated DMCA agent as described below.
Your notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material you claim is infringing, with enough detail for us to locate it.
- Your contact information, including name, address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

We will respond to valid DMCA notices by removing or disabling access to the allegedly infringing content. We may notify the user who posted the content of the takedown. Repeat infringers may have their accounts terminated. If you believe content was wrongly removed, you may submit a counter-notice in accordance with the DMCA. Submitting a false or bad-faith DMCA notice may expose you to legal liability.
11. Beta Features & Previews
From time to time, we may offer new or experimental features on an early-access or beta basis (collectively, “Beta Features”). Beta Features are provided for testing and feedback purposes and may not meet the same standards of reliability, security, or completeness as the core Service.
- No warranty. Beta Features are provided “as is” and “as available,” with no additional warranties beyond those stated in Section 13 (Disclaimers). We may modify, suspend, or discontinue any Beta Feature at any time without notice.
- Data handling. Beta Features may have reduced or different privacy and security protections than the core Service. We will clearly label Beta Features and disclose any material differences in data handling before you use them.
- Feedback. Your feedback on Beta Features is especially valuable to us and is subject to the feedback license in Section 9.
- Liability. Our limitation of liability in Section 14 applies fully to Beta Features, and we expressly disclaim liability for any data loss, errors, or interruptions arising from your use of Beta Features.
12. Privacy
Your use of the Service is subject to our Privacy Policy, available at ForWhenIGo.com/privacy. The Privacy Policy explains how we collect, use, store, and share your personal information, and is incorporated into these Terms by reference. By using the Service, you agree to the Privacy Policy.
In the event of any conflict between these Terms and the Privacy Policy with respect to privacy matters, the Privacy Policy controls.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, BLUE BUTTERFLY INC. AND WHENIGO DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant that any content you store through the Service — including uploaded legal documents — will be available at any particular time or that it will be error-free.
WhenIGo is a planning and storage tool only. We make no representation that the wishes, instructions, or legal documents stored in your plan will be honored, enforced, or legally valid. You should consult a licensed attorney regarding the legal validity of any documents or instructions in your plan.
We are not responsible for the acts or omissions of any Third-Party Partner, including the quality of their services, their compliance with applicable law, or their use of your personal information.
While we make no legally binding uptime guarantee, we are committed to maintaining the Service with reasonable availability and will make commercially reasonable efforts to minimize downtime. We understand that your plan content may be urgently needed by your family or trusted contacts, and we take that responsibility seriously. We will notify users of any planned maintenance or significant outages in advance where possible.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BLUE BUTTERFLY INC. AND WHENIGO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR NON-ECONOMIC DAMAGES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO WHENIGO IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless Blue Butterfly Inc., WhenIGo, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of or access to the Service.
- Your Content, including any claim that Your Content infringes a third-party right.
- Your violation of these Terms or any applicable law.
- Your interactions with any Third-Party Partner.
16. Account Termination
- Cancellation by you. You may cancel your subscription and delete your account at any time by contacting us at support@forwhenigo.com or through the account settings in the app. Upon cancellation, you will retain access through the end of your current paid period, after which your account and data will be deleted in accordance with our Privacy Policy.
- Termination by us. We may suspend or terminate your account if we believe you have violated these Terms or if required by law. For non-emergency violations (such as acceptable use infractions that do not pose immediate risk), we will provide at least 7 days’ written notice before termination, giving you the opportunity to remedy the violation if possible. For serious or emergency violations — such as security threats, illegal activity, or conduct that puts other users at risk — we may suspend or terminate your account immediately and without prior notice.
- Effect of termination. If your account is terminated for violation of these Terms, you are not entitled to a refund of any fees paid.
- Service discontinuation. If we discontinue the Service, we will provide at least 60 days’ notice and give you the opportunity to download or export your plan content before deletion.
17. Governing Law
These Terms and any disputes arising out of or related to them or the Service are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Blue Butterfly Inc. is incorporated in Delaware, and Delaware law governs the interpretation and enforcement of these Terms.
Nothing in this section limits any rights you may have under applicable federal or state consumer protection law.
18. Dispute Resolution
We want to resolve any concerns you have quickly and fairly. Before filing any formal legal claim, we ask that you contact us at support@forwhenigo.com and give us 30 days to try to resolve the issue informally.
- Arbitration. If we cannot resolve a dispute informally, any claim arising out of or related to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except as provided below.
- Small claims exception. Either party may bring an individual claim in small claims court if the claim qualifies.
- No class actions. You and WhenIGo agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit against WhenIGo.
- Equitable relief. Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent unauthorized use of intellectual property or other irreparable harm.
Some states do not allow mandatory arbitration or class action waivers for consumer contracts. If you reside in such a state, the arbitration and class action waiver provisions above may not apply to you.
19. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by a prominent notice in the app at least 30 days before the changes take effect. Your continued use of the Service after that date constitutes your acceptance of the updated Terms. The “Last Updated” date at the top of this document reflects the most recent revision. Prior versions are available upon request.
20. General Provisions
- Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blue Butterfly Inc. regarding the Service and supersede all prior agreements.
- Severability. If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.
- No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it in the future.
- Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations to a successor in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, internet outages, or government actions.
- Surviving provisions. The following sections survive termination of your account and continue in full force: Section 5 (Your Content — ownership), Section 9 (Intellectual Property), Section 13 (Disclaimers), Section 14 (Limitation of Liability), Section 15 (Indemnification), Section 17 (Governing Law), and Section 18 (Dispute Resolution).
